Welcome to the AutoMarket Service Wheels & Tires website (“we”, “us”, “our”). By using this website and/or purchasing products or services from us, you agree to these Terms & Conditions (“Terms”). If you do not agree to these Terms, please do not use our site or place an order.
1. Definitions
• “Customer”, “you”, “your” means the person or entity using the website or purchasing from us.
• “Products” means wheels, tires, rims, automotive accessories, and any other goods we offer.
• “Services” means installation, maintenance, repair, detailing, and other services provided by us.
• “Promotions” means any discounts, special offers, deals, or limited-time offers we advertise.
2. Ordering & Deposits
• When you place an order for Products and/or Services, you may be required to pay a deposit to secure the order, shipping/customization, or special-order items.
• All Deposits are non-refundable. The deposit covers our cost of shipping, special order fees, labour allocation, or other associated costs incurred once the order is placed.
• If you cancel the order after placing the Deposit, you forfeit the Deposit and it will not be credited or applied toward other purchases.
• Final payment is due after installation unless otherwise agreed in writing.
3. Shipping, Delivery & Installation
• Shipping costs, handling, customs/import duties (if applicable) are your responsibility unless otherwise stated.
• We will endeavour to provide estimated shipping or installation dates; however, delays may occur. We are not liable for delays beyond our control (e.g., carrier issues, strikes, customs delays, weather).
• Installation of wheels/tires must be booked in advance. You agree to provide accurate vehicle information and access as required.
• If you fail to attend a scheduled installation/service appointment without prior notice, your appointment may be rescheduled at our discretion.
4. Promotions & Discounts
• Any Promotion we advertise is subject to the terms specified for that particular Promotion.
• Current Promotions cannot be combined with any other Promotions, discounts, or special offers unless expressly stated in writing.
• We reserve the right to withdraw or modify Promotions at any time, without prior notice.
• All Promotions are subject to availability and may be limited to certain products/services, timeframes, or quantities.
5. Payment Terms
• We accept Debit, Visa, Mastercard, American Express, E-Transfer, and payments through approved financing options.
• Please contact our shop for details on additional accepted payment methods.
• Full payment must be made in cleared funds prior to delivery, and after installation, or service execution unless otherwise agreed.
• If payment is not received when due, we may, at our discretion, delay or cancel delivery, installation or service without liability.
Financing:
• All financing options offered through AutoMarket Service are provided by third-party financing companies.
• We do not control, set, or influence the interest rates, approval decisions, or terms of those financing agreements.
• Customers are strongly advised to review all financing terms, conditions, and interest rates carefully before completing their application.
• AutoMarket Service is not responsible for any financing terms, approvals, denials, payment obligations, or interest charges associated with third-party financing providers.
• Any disputes or concerns regarding financing agreements must be handled directly with the financing provider.
6. No Return Policy
• All sales are final. Due to the nature of our products and services, such as custom orders, tire installations, or special-order items, we maintain a strict No Return Policy.
• Once an order is confirmed and payment (including deposit) is made, it cannot be cancelled, exchanged, or refunded.
• Please verify all specifications, fitment details, and compatibility before confirming your order.
7. Liability & Warranty
• We will endeavour to ensure Products and Services meet reasonable standards of quality and performance. Any warranty will be as per the manufacturer (for Products) or as stated at the time of service.
• Except where prohibited by law, our liability for any claim whether in contract, tort (including negligence), product liability or otherwise is limited to the value of the purchase.
• We are not liable for any indirect, incidental, special or consequential damages (including loss of income or business interruption).
• You agree to follow manufacturer instructions or service advisories. Failure to do so may void warranty coverage.
8. Intellectual Property
All content on our website (text, graphics, logos, images) is owned or licensed by us, and is protected by intellectual property laws. You may view and print pages for your personal, non-commercial use only. You may not reproduce, distribute, modify, or create derivative works without our prior written consent.
9. Privacy
Our Privacy Policy governs how we collect, use and protect your personal information. By using our website and placing an order you consent to our Privacy Policy.
10. Modification of Terms
We may update or revise these Terms from time to time. The revised Terms will be posted on our website with a new Effective Date. Your continued use after such changes constitutes acceptance of the new Terms.
11. Governing Law & Jurisdiction
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any dispute arising from these Terms or your use of our website will be resolved in the courts of Ontario in the City of Guelph (or another agreed location).
12. Severability
If any part of these Terms is found to be invalid or unenforceable under applicable law, the remaining parts will continue in full force and effect.
